{"id":257490,"date":"2022-06-27T04:18:11","date_gmt":"2022-06-27T04:18:11","guid":{"rendered":"https:\/\/www.gaytimes.co.uk\/?p=257490"},"modified":"2022-06-27T09:17:52","modified_gmt":"2022-06-27T09:17:52","slug":"japanese-court-rules-same-sex-marriage-ban-as-constitutional","status":"publish","type":"post","link":"https:\/\/www.gaytimes.com\/life\/japanese-court-rules-same-sex-marriage-ban-as-constitutional\/","title":{"rendered":"Japanese court rules same-sex marriage ban as constitutional"},"content":{"rendered":"<p>In a massive blow to LGBTQ+ rights, a Japanese court has ruled that banning same-sex marriage is constitutional.<\/p>\n<p>In 2019, numerous LGBTQ+ couples filed a lawsuit against the government, claiming the country violated their constitutional right to marry.<\/p>\n<p>The couples also requested that they each be paid 1 million yen (\u00a36058) in damages for being discriminated against, as reported by <a href=\"https:\/\/www.npr.org\/2022\/06\/20\/1106313824\/japan-court-ban-on-same-sex-marriage-constitutional\">NPR.<\/a><\/p>\n<p>In 2021, <a href=\"https:\/\/www.gaytimes.co.uk\/culture\/japans-ban-on-same-sex-marriage-is-ruled-unconstitutional-in-landmark-case\/\">a Sapporo court ruled that the ban on same-sex marriage was unconstitutional.<\/a><\/p>\n<p>Judge Tomoko Takebe said in the historic ruling that preventing same-sex marriages violates Article 14 of the Japanese constitution, which bans discrimination based on &#8220;race, creed, sex, social status or family origin.&#8221;<\/p>\n<p>However, a year after the groundbreaking ruling in Sapporo, a district court in Osaka ruled against three LGBTQ+ couples and their call for same-sex marriage.<\/p>\n<p>&#8220;From the perspective of individual dignity, it can be said that it is necessary to realise the benefits of same-sex couples being publicly recognised through official recognition,&#8221; the court said on 20 June.<\/p>\n<p>&#8220;Public debate on what kind of system is appropriate for this has not been thoroughly carried out.&#8221;<\/p>\n<p>The court also dismissed the three couples&#8217; \u2013 two male and one female \u2013 request for one million yen (\u00a36058) in damages.<\/p>\n<p>Currently, Japan&#8217;s constitution defines marriage as &#8220;mutual consent between both sexes&#8221; and bans same-sex marriage.<\/p>\n<p>The document also states that gay couples are unable to inherit each other&#8217;s assets or share parental rights over each other&#8217;s kids.<\/p>\n<p>As an alternative to marriage, some municipalities within the country have issued non-legally binding certificates which allow partners to rent apartments together, grant hospital visitations and allow certain employment benefits.<\/p>\n<p>Shortly after the ruling, the plaintiff&#8217;s lawyer Akiyoshi Miwa revealed that they would appeal the decision in a statement.<\/p>\n<p>&#8220;We emphasised in this case that we wanted same-sex couples to have access to the same things as regular couples,&#8221; Miwa told <a href=\"https:\/\/www.reuters.com\/world\/asia-pacific\/japan-court-rules-barring-same-sex-marriage-not-unconstitutional-lgbtq-rights-2022-06-20\/\">Reuters.<\/a><\/p>\n<p>According to the <a href=\"https:\/\/www.bbc.com\/news\/world-asia-61670667\">BBC<\/a>, Japan is the only country in the G7 group of developed nations that restricts same-sex marriage \u2013\u00a0despite the general public supporting it.<\/p>\n<p>As of 2019, Taiwan is the only Asian country to recognise same-sex marriage.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a massive blow to LGBTQ+ rights, a Japanese court has ruled that banning same-sex marriage is constitutional.
